Customer guarantees in an air passenger transport contract - A seminar at the Faculty of Law at Al al-Bayt University
The Faculty of Law at Al al-Bayt University held a seminar entitled "Guarantees of Customers in the Air Passenger Transport Contract," in which the head of the Private Law Department at the college, Dr. Muhammad Bani Khaled, spoke about the most prominent guarantees provided by air transport companies to passengers in the event of flight cancellation, including the necessity of informing him of the cancellation of the flight and granting him the option of an alternative flight or a full refund of the ticket value. The passenger also has the right to care, the right to assistance, and the right to monetary compensation. Dr. Al-Khalidi explained that there are two cases in which the carrier is exempt from paying compensation to the passenger if the flight cancellation is due to force majeure, such as earthquakes and floods, or if the passenger does not adhere to travel instructions, adding that there are cases in which the air transport company has the right to prevent the passenger from boarding the plane if he is infected with a contagious disease, needs special care, is insane, or has a criminal record.
For his part, Dr. Saber Al-Mazaal from the Faculty of Law spoke about the case of cancellation of the reservation, in which the passenger has the right to recover the full value of the ticket or obtain an alternative flight in addition to monetary compensation. Airlines are also obligated to provide care, support services, and meals to the passenger, and appropriate accommodation in the event of a long delay. He explained that if the passenger's flight class is changed to a higher class, the passenger is not obligated to pay additional amounts, but if the class is changed to a lower class, the passenger is compensated for the price difference between the two classes.
At the end of the seminar, which was attended by faculty members of the college and its students, an extensive dialogue took place on the topic of the seminar.
