Rule: ?Judging a thing is a branch of its perception? and its applications in contemporary banking transactions (Applied original study)
The rule of " Judging on a matter is an integral part of its general conceptual understanding " which has a great significance. The importance of this rule lies in its guidance to make jurisprudence about understanding the matter completely in order to come up with the closest Fatwa to the Islamic jurisprudence. It showed the clear meaning and understanding of the rule in addition to its principles, importance and application on the modern financial dealings.The main findings of this study show that the rule means that a judgment on any matter cannot be issued until having a thoughtful and thorough vision and a complete understanding as well that matches the matter precisely which is aligned with its nature and distinguishes it from other similar matters, through focusing on the cause and the result and other related subjects with the idea of effect and influence in mind. Therefore, matters should not be given judgement until having a full understanding and knowledge. This study revealed that this rule has a unanimous consensus among experts and people of jurisprudence, and it does not include any exceptions, and also cannot be excluded when judging the jurisprudential concerns, especially in financial dealings when there are many versions of the same matter, thus yielding different jurisprudential views accordingly.
