The plea of non-payment of the leagal fee for the lawsuit in the jordanian sharia Courts. .( jurisprudence and leagal and applied study) Abstract This paper examines the plea of non-payment of the legal fee for the lawsuit, and clarifies the definition of legal fee, its relationship to the judge?s decision, the extent of its legitimacy, and the wisdom of its imposition. Furthermore, this paper sheds light on the main types of this plea, the time to raise it, who is authorized to raise it, and the consequences that follow when the fee is not paid in full. As such, this study is divided into five main parts and aconclusion. The first part explores the main terms of the study, while the second part critically discusses the provisions of collecting fees on cases, and the wisdom thereof. In the third and fourth parts, the paper clarify the legal recognition of the payment of afee on the case, the type of the plea for non-payment of the legal fee, and the time of its raising. In the fifth part, the lack of full payment and its effect is thoroughly considered.
