"The Returning of the Guarantor to the Principal Party"

The returning of the Guarantor to the principal party is one of the important issues that need to be addressed carefully especially in regard to the relationship of both parties and the doctrinal nature of the warranty contract. Therfore, this study juridically examines such issues in comparison to the Jordanian Civil Law. It also aims at exploring the cases under which the Guarantor may return to the principal and what are the coditions that should be fulfilled in these cases, and whether or not the payment in this regard should be from the same kind of debt. It expresses when it should be returned in reference to the specific articles of the Jordanian Civil Law .
