Internal and external mobility in the form of a jurisprudential study compared to the Jordanian Personal Status Law

The present research aims to address an important issue regarding the travel of infant with one of his / her parents inside or outside Jordan after the divorce. Such issue needs to be discussed in depth in terms of Sharia rulings that govern the travel of infant with one of his / her parents. This research has come to the conclusion that the judge has been given the legal right to evaluate the interest of the child in light of our modern life. However, the infant can travel with his / her father or mother inside or outside Jordan under certain legal; conditions. The researcher has also compared the dissection of Sharia rulings of this issue with Jordan?s Family Law No. 36 of 2010
